CFDs May Not Be Illegal in the USA Much Longer

Even if CFDs are offered in countries all over the globe such as Australia, Canada, Singapore, Japan, the UK, Why are they not accessible in the US? CFDs are on over the counter derivative and as such are unregulated by the SEC. They are accessible in the US but only for the professional and sophisticated traders and not for the public.

But all that is about to change.

With concerns lingering about derivatives and the impact on the US housing market, it is not an easy environment to launch a new derivative product. Instead of changing the existing rules, the IG markets came up with a solution to work around the current regulations.

This UK-based company would like to use Nadex a retail-oriented futures exchange in the US to facilitate the type of products in which the company is very much popular for in the other markets. The IG Group considers it a huge decision as Nadex lately secured regulatory permission from the US Commodity Futures Trading Commission for a couple of technical changes. This lets retail investors binary trading and spreads on equity futures, forex, and commodities with the help of intermediaries.


It is the IG Markets’ belief that based on the client’s perspective, the products that it included in its plan of offering in the USE would in a lot of ways be "to all extents and purposes the same as CFDs", with only one difference though and that is they will not allow for trading in individual stocks.

Still industry analysts and the experts in the field put out their warning that even is the potential for demand in the US is great, the IG may still be facing some mighty challenges. Some observers doubt about its success because its rival tried and failed to enter the country. CMC Markets started an office in New York earlier in the decade while looking at an expansion, but it also closed it two years ago because of difficulties that arise from the strict regulatory regime. However the CMC Markets had a successful launch of CFDs in Canada after three years of waiting for regulatory approval.

IG Markets are pretty confident that they are able to have a successful launch. Mr. Beinart says that IG Markets, through Nadex, has sought to capitalise on regulators' desire to shift over-the-counter financial products on to exchanges. To note: "They like everybody to trade everything on exchange. We are exactly what the regulator wants."
